The terms of cancellation differ depending on when you cancel, the circumstances under which the contract is canceled, whether or not service has been requested and the state in which the home is located.
The cancellation terms of a contract will typically be something like this:
Within 30 days and no claims: If you can cancel your home warranty contract within the first 30 days of your policy coming into effect, you are eligible to a full refund of the contract’s cost. That is if you haven’t made a service request.
If claims have been filed: If you cancel the contract within 30 days from the policy coming into effect after filing a claim or anytime after that, you will receive a refund of the unearned contract fees that is based on a shirt rate schedule minus a processing fee of $25 and the cost of services received from the company during the agreement. This may even lead to you owing to the company sometimes. In such a case, 2-10 HBW will charge you the net amount due to the company or the unpaid contract fee, whichever is lesser.
In a case of fraud: 2-10 HBW may also terminate the contract after any applicable provision, due to fraud, material misrepresentation, or non-payment. In this case, the company will repay all the paid contract fees if you haven’t placed any claims. If a claim has been made, the usual cancelation terms will be followed.
